1. Overview and acceptance

This online merchandise store is operated by Sea Wolf Adventures BC Inc., operating as Sea Wolf Adventures. Throughout these Terms of Service, “Sea Wolf Adventures,” “we,” “us,” and “our” refer to Sea Wolf Adventures BC Inc. These Terms govern your access to and use of this store, its content, and the purchase of merchandise through it. Shopify provides the ecommerce platform that enables us to offer the store.

By visiting the store, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, Return and Refund Policy, Shipping Policy, and any additional terms displayed for a product or promotion. If you do not agree, do not use the store. These merchandise-store Terms do not govern tour bookings or wilderness experiences unless a tour page expressly incorporates them.

2. Eligibility

You must be at least the age of majority in your place of residence, or use the store with the involvement and consent of a parent or legal guardian. You may not use the store for an unlawful or unauthorized purpose or in a way that violates any applicable law.

3. Account and order information

You agree to provide current, complete, and accurate purchase, billing, delivery, and account information and to update it when necessary. You are responsible for safeguarding any account credentials and for activity under your account. Notify us promptly if you believe an account has been used without authorization.

4. Products and made-to-order fulfilment

Merchandise is made to order by a third-party fulfilment partner. We make reasonable efforts to display product descriptions, colours, artwork, sizes, and images accurately, but device displays and production processes can cause minor variations. Measurements and size guides are approximate. Product availability, production location, materials, and packaging may change when reasonably necessary, provided the item remains materially consistent with its description and applicable law.

We may limit quantities, discontinue a product, correct an error, or refuse or cancel an order where reasonably necessary, including for suspected fraud, pricing or description errors, inventory or fulfilment constraints, sanctions or shipping restrictions, or unauthorized resale. If we cancel a paid order, we will refund the cancelled amount.

5. Prices, payment, taxes, and promotions

Prices and currencies are displayed for the selected market and may change without notice before an order is placed. The price confirmed at checkout applies to that order, except where an obvious error is identified and applicable law permits correction. You authorize us and our payment processors to charge the payment method submitted for the order total.

Applicable sales taxes, shipping charges, and any discounts are calculated at checkout. For international delivery, import taxes, customs duties, brokerage charges, or similar destination charges may be payable by the recipient unless checkout expressly states that they are included or prepaid. Promotional offers may have separate eligibility, duration, product, market, or redemption conditions.

6. Shipping, returns, and refunds

Production, delivery, tracking, customs, address issues, and lost or damaged parcels are governed by our Shipping Policy. Cancellations, returns, exchanges, defects, statutory withdrawal rights, and refunds are governed by our Return and Refund Policy. Those policies form part of these Terms.

7. Intellectual property and cultural content

The store and its content—including the Sea Wolf Adventures name, logos, artwork, photography, video, written material, product designs, graphics, and layout—are owned by or licensed to Sea Wolf Adventures and are protected by copyright, trademark, and other intellectual-property laws. Cultural knowledge, stories, names, imagery, and expressions presented through the store must be treated respectfully and may also be subject to Indigenous cultural rights, protocols, and community responsibilities.

You may access the store for personal, non-commercial shopping. You may not copy, reproduce, modify, publish, sell, license, scrape, frame, distribute, create derivative works from, or commercially exploit store content without our prior written permission, except as permitted by mandatory law.

8. Reviews, messages, and submitted content

If you send a review, comment, photograph, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, respectful, and does not infringe another person’s rights. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, and display that content for operating and promoting the store, subject to our Privacy Policy and any mandatory law. We may remove submitted content that is unlawful, misleading, abusive, infringing, or otherwise inappropriate.

9. Prohibited conduct

You must not interfere with the store’s security or operation; introduce malware or harmful code; scrape or harvest data without authorization; impersonate another person; submit false information; infringe intellectual property, privacy, publicity, or other rights; use the store for fraud or unlawful activity; or attempt to bypass access, purchase, market, or security controls.

10. Third-party services and links

Shopify, payment processors, fulfilment providers, carriers, analytics providers, and other service providers may process information or perform parts of the transaction under their own terms and privacy notices. The store may link to third-party websites. We do not control and are not responsible for third-party content, availability, security, or practices, except to the extent applicable law provides otherwise.

11. Accuracy and availability

We aim to keep store information accurate and the service available, but errors, interruptions, maintenance, or delays can occur. We may correct errors and update information. To the maximum extent permitted by law, the store is provided on an “as available” basis. Nothing in these Terms excludes any representation, warranty, consumer guarantee, or remedy that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Sea Wolf Adventures and its directors, officers, employees, contractors, and service providers are not liable for indirect, incidental, special, exemplary, or consequential loss, or loss of profit, revenue, data, goodwill, or opportunity arising from use of the store or purchase of merchandise. Where liability cannot be excluded but may be limited, our aggregate liability relating to a merchandise order will not exceed the amount paid for the affected order, except where applicable law requires a different remedy or limit.

This section does not limit liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where such liability cannot be limited, breach of non-waivable consumer guarantees, or any other liability that applicable law prohibits us from excluding or limiting.

13. Indemnity

To the extent permitted by law, you agree to reimburse Sea Wolf Adventures for reasonable losses, liabilities, and costs resulting from your unlawful use of the store, your material breach of these Terms, or content you submit that infringes another person’s rights. This section does not apply where or to the extent prohibited by consumer law.

14. Suspension and termination

We may suspend or terminate access to the store if you materially breach these Terms, misuse the service, or create a security, legal, or fraud risk. Provisions that by their nature should survive termination—including intellectual property, liability, and governing-law provisions—will continue to apply.

15. Governing law and disputes

These Terms and merchandise purchases are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The courts of British Columbia have non-exclusive jurisdiction. Before starting formal proceedings, please contact us so we can try to resolve the issue promptly.

If you are a consumer outside British Columbia, this choice of law and forum does not deprive you of any mandatory protection or right to bring a claim in a forum that cannot lawfully be excluded under the law of your usual place of residence.

16. Changes, severability, and entire agreement

We may update these Terms by posting a revised version with a new “Last updated” date. Changes apply prospectively unless applicable law requires otherwise. If a provision is held unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. These Terms and the policies incorporated into them are the entire agreement concerning use of this merchandise store, except for any additional terms expressly accepted at checkout.
